PACIFIC INTERCLUB LEAGUE (PIL) – TERMS, CONDITIONS, PRIVACY POLICY & LIABILITY WAIVER

These Terms & Conditions govern all use of the Pacific Interclub League (“PIL,” “we,” “our,” or “us”), including participation in league activities, viewing our website, registering for a league, or accessing any information or communication provided by PIL. By accessing the website, registering for any team, or participating in any PIL match, you acknowledge that you have read, understood, and agree to be bound by these Terms, which may be updated from time to time. Continued participation constitutes acceptance of updated Terms.
PIL is a regional league organizer. PIL does not own, operate, inspect, supervise, or control any participating club or facility. Clubs remain solely responsible for their courts, facility safety, staff, and on-site operations.
1. Eligibility and Participation
Players must participate through a staffed, approved club. Clubs determine their own internal membership or eligibility requirements. PIL sets competition rules, schedules, ratings requirements, playoff formats, and conduct standards. By participating, you agree to follow all PIL rules, match procedures, and administrative decisions, which are final.
2. Player and Club Responsibilities
Clubs are responsible for providing a safe, insured facility; complying with all local laws; managing court access; hosting home matches; and ensuring participants meet club-specific requirements. Players are responsible for reading all PIL rules, arriving on time, following host-club rules, and competing safely and fairly.
3. Code of Conduct
All participants must behave respectfully toward opponents, referees, coordinators, and club staff. Harassment, threats, abusive language, unsafe play, or unsportsmanlike behavior may result in warnings, suspensions, match forfeits, or removal from the season without refund. PIL may remove any player or team at its sole discretion to protect the integrity or safety of the league.
4. Scheduling, Match Changes, and No Guarantee of Play
Match schedules are published by PIL. While PIL attempts to honor published schedules, matches may be rescheduled, relocated, or cancelled due to facility conflicts, weather, club discretion, emergencies, or other operational reasons. PIL does not guarantee a minimum number of matches, court availability, or season completion.
5. Refunds and Credits
All fees paid to PIL are final. No refunds or credits are issued for:

Player withdrawal

Team withdrawal

Club withdrawal

Schedule changes
-
Missed matches
-
Partial or full season cancellations due to facility issues, weather, emergencies, or force majeure events
If PIL cancels an entire season before start, PIL may issue credits at its discretion. Clubs may have their own internal refund processes for team or membership fees; those are separate and not governed by PIL.
6. Media, Name, Image, and Likeness (NIL) Rights
By participating in PIL, you grant PIL a perpetual, royalty-free, worldwide license to use your name, image, likeness, voice, team affiliation, performance statistics, and match results for marketing, standings, promotional content, media coverage, website/social media use, and brand materials. You waive all rights to inspect, approve, or receive compensation for such use. PIL will never sell personal data or likenesses to third parties.
7. Privacy Policy and Data Use
PIL collects participant data including names, emails, phone numbers, ratings, match results, schedule participation, club affiliation, and communication preferences. PIL uses this information for:

Playoff and standings management

Marketing emails and promotional announcements

Website or social-media updates

Coordination with clubs, captains, and technology partners
PIL does not sell personal data to any third party. Data may be shared with clubs for operational purposes. You consent to receive emails, texts, and notifications from PIL. You may opt out of marketing communications at any time, though operational emails cannot be disabled.
8. Accessibility Statement
PIL is committed to making its website and digital materials accessible to all users. We strive to comply with WCAG 2.1 AA standards where reasonably possible. If you experience difficulty accessing any content, please contact PIL, and we will make reasonable efforts to provide the requested information in an accessible format.
9. Assumption of Risk
Participation in pickleball involves inherent risks, including but not limited to falls, collisions, equipment failure, weather conditions, facility hazards, and actions or negligence of other participants. By participating, you voluntarily assume all risks associated with the activity. PIL does not own or inspect any court or facility and disclaims responsibility for facility safety, playing surfaces, lighting, equipment, or emergency response.
10. Release and Waiver of Liability
To the fullest extent permitted by Oregon law, you release and waive all claims against PIL and its officers, directors, employees, agents, volunteers, successors, and assigns arising out of or related to:

Injuries or accidents during participation

Facility conditions or hazards

Actions or omissions of clubs, players, captains, or spectators

Match operations, scheduling, officiating, or administration

Weather-related disruptions

Use of your likeness or data
This waiver does not apply to claims that Oregon law does not allow to be waived (such as gross negligence or willful misconduct).
11. Indemnification
You agree to defend, indemnify, and hold harmless PIL from all claims, losses, damages, attorney fees, and liability arising from:

Your participation in any match

Your actions toward other participants or facilities

Violation of any rule or agreement

Use of your data or likeness as permitted under these Terms
12. Intellectual Property
PIL owns all rights to its trademarks, branding, rules, formats, schedules, website content, and league materials. No individual or club may reproduce, distribute, modify, or commercialize PIL content without written permission.
13. Facility Liability Disclaimer
Clubs hosting matches are solely responsible for:

Facility maintenance

Safety conditions
-
Court readiness
-
Emergency response
-
Compliance with local laws
PIL is not responsible for any injury, accident, or damage occurring at a club facility.
14. Modification of Terms
PIL may update these Terms at any time. Updates become effective when published on the website. Continued participation after updates constitutes acceptance.
15. Dispute Resolution
All disputes must be resolved through good-faith negotiation. If unresolved, disputes shall be settled through binding arbitration in Multnomah County, Oregon, under Oregon law. No class actions are permitted.
16. Governing Law
These Terms are governed exclusively by the laws of the State of Oregon.
17. Severability
If any clause of these Terms is found unlawful, invalid, or unenforceable, that clause shall be modified only to the extent needed to make it enforceable, or else removed. All remaining sections remain in full force and effect.
18. Entire Agreement
These Terms constitute the full and complete agreement between you and PIL regarding website use and league participation and supersede all prior understandings or agreements.
